New CCPA and GDPR clarification amendment to eMerges Policy - eMerges response to the California Consumer Privacy Act and EU General Data Privacy Regulation.
PUBLIC RECORDS WE COMPILE: eMerge’s (eM) compiles some of these town, county and/or state public records:
- hunting, pilot and fishing licenses
- water, aircraft, ATV and snowmobile registrations
- political campaign and issues contributors
- registered voter lists
- occupational and professional licenses
- carry concealed weapon permit holder permits
Except for records suppressed by the government such as is the case with protective court orders, the public records usually contain so called personal information such as name, address, birth date and specific to each source file; license type, registration or similar permit data points such as boat manufacturer type, game hunted, planes permitted to pilot, political party and so forth.
WHAT eM LICENSES OR RESELL'S: eMerge’s standardizes the data while performing data hygiene such as correcting addresses. eMerge’s licenses, sells or brokers the raw or enhanced public records to other statutorily permitted or non-restricted users and resellers which include but are not limited to voter fraud prevention, academic and scholarly uses, polling, epidemiological studies, political campaigns, database brokering, identity authentication and fraud prevention professionals to name a few. In some case we purchase data from other brokers that append phone number, race, ethnicity, home ownership and so on to eMerge’s various public records or their own data.
CALIFORNIA CCPA: Pursuant to AB-874 eMerges sells and licenses only public records however since January 1, 2019 and out of an abundance of caution, eMerges has been removing any record that presents California as a home or mailing state such as the case where a hunter who resides in Los Angeles for instance obtains a permit to hunt bear in Alaska---we delete their record entirely unless it is for political use or similarly exempt as provided herein.
EU GDPR: With respect to the European Union General Data Privacy Regulation (EU GDPR) eMerges has been avoiding any EU GDPR conflict since May 25, 2018 by reselling only records that contain a home or mailing address from: (a) any of the fifty states (while continually excluding CA) and (b) including DC and these territories: AS, FM, GU, MH MP, PR, VI as well as (c) including these Armed Forces addresses: AA, AE and AP.

Although snide comments are appreciated please stay focused on providing complete correct information so we may ensure we find an exact match. We then remove your record prior to resell or licensing. Some government related or political users may have exceptions, consumer reporting agencies covered by the federal Fair Credit Reporting Act, financial institutions covered by the Gramm-Leach-Bliley Act, and entities covered by the Insurance Information and Privacy Protection Act may all be exempted from particular data broker statutes’. 20191022

Our forms require web site visitors to give us contact information (such as phone, email, name and interest). eMerges potential client and client contact information from the registration forms to send the visitor information about our company or to contact the visitor if required.
Our site uses an order form for you to request information or products and services. We collect visitor’s contact information (like your email address) and we rely on PayPal for processing credit card numbers. We do not see or store any credit card information. Contact information from the order form is used to send orders and information about our company to you.

Registered Voter List, Campaign Contributor and Carry Concealed Weapon Permit Holder etc. Data Restrictions

Permitted use of political donor data also varies by state. FEC Reports and statements filed by political committees may be inspected and copied by anyone. The names and addresses of individual contributors, however, may not be sold or used for any commercial purpose or to solicit any type of contribution or donation, such as political or charitable contributions. 2 U.S.C. §438(a)(4); 11 CFR 104.15. This restriction applies to Federal reports and statements. Any person who violates this restriction is subject to the penalties of 2 U.S.C. §437g.
Personally identifiable information provided for purposes of age and identity verification and authentication or fraud prevention or other uses as may be permitted or non-restricted by local, state or federal law.
SSA Death Master File Restrictions
Certain data provided by eMerges may include information obtained from the Death Master File (DMF) made available by the US Department of Commerce National Technical Information Service (NTIS) and subject to regulations found at 15 CFR Part 1110. All eMerges' clients are required to comply with all applicable laws and, if Subscriber is granted access to DMF data, Subscriber certifies compliance with 15 CFR Part 1110. Subscriber’s failure to comply with 15 CFR Part 1110 may subject Subscriber to penalties under 15 CFR 1110.200 of $1,000 for each disclosure or use, up to a maximum of $250,000 in penalties per calendar year.
Confidentiality of Information/Correction
eMerges does not provide visitors’ information to third parties.
When you use the eMerges Site, you are accepting the terms and conditions of this Privacy Policy, and eMerges will have the right to use your information as described in this Privacy Policy.
